Privacy Policy

This Privacy Policy outlines how Ekovest Berhad, its subsidiaries, related corporations, associated companies, affiliates and joint venture companies as well as their representatives (collectively, “Ekovest”) collect, use, disclose and process your Personal Data in respect of transactions with Ekovest.
For the purpose of this Privacy Policy, the terms “we”, “our”, “us” shall refer to any company or representative within Ekovest and the terms “you” and “your” shall refer to yourself and/or such other persons or companies represented by you of which you are providing Personal Data.
In this Privacy Policy, “Personal Data”, “collect”, “use”, “disclose”, and “process” shall have the same meanings as defined in the Personal Data Protection Act 2010 [Act 709] “PDPA” (as may be amended from time to time) and its corresponding regulations, standards, guidelines, notices and/or practices issued thereunder.
Such Personal Data which you may provide or make available to Ekovest include information concerning your personal details (such as name, identity card number, passport number, date of birth, age, gender, race, nationality), contact details and any other relevant information that you have disclosed to Ekovest depending on the nature of dealings or transactions (as may be updated from time to time).
In the course of your dealings with Ekovest, you may have furnished your Personal Data to Ekovest and in doing so, you acknowledge and confirm that you are providing to us accurate, complete, not misleading and up-to-date Personal Data and further agree and consent to Ekovest collecting, using, disclosing, processing and retaining your Personal Ekovest, its officers and/or employees shall not be liable for any inaccurate, incomplete, misleading or not up-to-date Personal Data provided by you.
In the event you furnish or make available to Ekovest any Personal Data relating to a third party, g. information of spouse, children, parents, directors, shareholders and/or guarantors (collectively the “Relevant Persons”), you represent and warrant that you have obtained the consent of the Relevant Persons for you to provide Ekovest with their Personal Data, which are accurate, complete, not misleading and up-to-date; and for Ekovest to collect, use, disclose, process and retain their Personal Data for the relevant purposes.
Notwithstanding the foregoing, Ekovest is not required to verify the accuracy and completeness of the Personal Data provided by you and Ekovest is entitled to treat the Personal Data provided by you as accurate, complete, not misleading and up- to-date.
Ekovest collects your Personal Data in various ways, in printed or electronic forms through digital and mobile platforms, such as:
1. when you / your representatives register or update an online profile or when you / your representatives complete or update your information with Ekovest;
2. when you / your representatives / employers submit completed forms, applications (including job applications) and/or documents to Ekovest;
3. when you enter into any transaction with Ekovest;
4. when you make payment related to any transaction with Ekovest;
5. when you / your representatives communicate with Ekovest’s employees;
6. when you visit our premises in person, g. sales galleries, offices or show units, through security or CCTV recordings;
7. from your personalised preference through the use of Ekovest’s website, social media accounts, mobile platforms operated or managed by Ekovest;
8. when you participate in Ekovest’s contests, events, market research and surveys;
9. from information obtained independently by Ekovest from other lawful sources; and
10. other purposes where you have provided us with information.
Ekovest may collect, use, disclose, process and retain your Personal Data for the following purposes:
1. considering and processing your application for and providing you with products and/or services of Ekovest as well as products and/or services by third party service providers provided through Ekovest;
2. facilitating, implementing and/or formalising any transaction with Ekovest;
3. processing any payments related to any transaction with Ekovest;
4. communicating with you including responding to queries, requests and/or complaints;
5. facilitating Ekovest’s customers loyalty programmes, customer relations events and activities;
6. updating your Personal Data;
7. facilitating your participation in Ekovest’s contests and events;
8. conducting market research and surveys with the aim of improving Ekovest’s products and /or services;
9. *providing you marketing, advertising and promotional information about other products / services that Ekovest, its business partners or third party service providers may be offering (“Marketing Information”), by way of postal mail to your address(es) and/or electronic transmission to your email address(es), text messages (SMS/MMS), telephone calls and/or other phone based messaging to your telephone number(s);
10. conducting credit / trade checks and other background checks on you and where applicable, any Relevant Persons with any registered credit reporting agency at any time for the purpose of processing a transaction with Ekovest or for as long as any dues remain unpaid and outstanding with Ekovest;
11. for the purpose of credit evaluation, review or reporting and carrying out debt-collection or assisting other institutions to do so;
12. prevention and detection of crime including without limitation to money laundering, terrorism and fraud prevention, detection and prosecution;
13. required by government authorities or otherwise in compliance with laws, rules, regulations, by-laws, orders, guidelines and/or directives issued by the relevant authorities;
14. enforcing Ekovest’s legal rights and/or obtaining legal advice;
15. facilitating any transaction with Ekovest, which may include opening of utility accounts, registering ownership, and managing and maintaining of common property;
16. facilitating business transactions which may include mergers, acquisitions or asset sales;
17. compliance with internal policies and procedures, including without limitation, risk management, product planning, insurance, audit and other administrative purposes;
18. for all ancillary purposes relating to the provision of facilities including the provision of computer, telecommunications and technology services;
19. human resource applications; and/or
20. any other incidental purpose relating to any of the above or any transaction with
  *Where you have consented to receiving Marketing Information and/or sharing your Personal Data with third parties for the purpose of Marketing Information, you may opt-out of receiving such Marketing Information or sharing of your Personal Data with third parties for the aforesaid purpose by contacting Ekovest in accordance with Section 15.
For the purposes as set out in Section 9, your Personal Data may/will be disclosed to the following parties:
1. any company or representative within Ekovest;
2. Ekovest’s third party service providers or agents (including without limitation auditors, lawyers, consultants, insurers, adjusters and utility companies);
3. any registered credit reporting agencies under the Credit Reporting Agency Act 2010 [Act 710];
4. Ekovest’s business partners, professional advisers, investors, assignees or transferees to facilitate business asset transactions (including without limitation to any merger, acquisition or asset sale);
5. any law enforcement agencies;
6. any governmental authorities or regulatory bodies; and
7. any other party authorised and consented by.
Ekovest may disclose your Personal Data to any or all of the parties stated above which may be located within or outside of Malaysia or involve sending your Personal Data to a location outside of Malaysia.
Ekovest takes the necessary precautions, both administrative and technical, to safeguard your Personal Data against loss, theft, misuse and unauthorised access, disclosure, usage, alteration or destruction.
You may, subject to a payment of a prescribed fee, any applicable legal restrictions and/or contractual conditions, request in writing for access to or a copy of your Personal Data.
We request that you ensure the Personal Data provided to us is accurate, complete, not misleading and up-to-date.

In the event we are unable to comply with your data access request or data correction request, we will inform you accordingly by written notice.
You have an option not to provide the additional Personal Data requested by Ekovest other than the information which is indicated as necessary to facilitate the transaction. If insufficient Personal Data is provided or your consent or the consent of any Relevant Person given herein is withdrawn, or your Personal Data or the Personal Data of any Relevant Person is deleted, Ekovest may not be able to continue our relationship with you, provide you with its products and services and/or fulfil any of your request to Ekovest or you may not be able to access or use some of the functionality of our website or mobile platforms.
Ekovest reserves the right to update and amend this Privacy Policy from time to Any material changes will be notified to you via the email address that you have provided or the updated Privacy Policy shall be posted on our website. Where required by applicable data protection laws we will obtain your consent to such changes.
